Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the SpeakEQ mobile application and related services (collectively, the “Service”) provided by SpeakEQ (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.

Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

Account Registration

To use certain features, you must create an account. You agree to provide accurate information, keep it up to date, and keep your credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use.

Use of the Service

SpeakEQ provides AI-assisted analysis of speech, tone, and expressive qualities to help you improve communication. The Service is provided for personal and professional self-improvement purposes. You agree to use the Service in compliance with these Terms and all applicable laws.

User Content

You retain ownership of the audio, text, and other content you submit to the Service (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, analyze, and display that content solely for the purpose of operating and improving the Service. You represent that you have the rights necessary to grant this license and that your User Content does not violate any law or third-party right. Where you record another person’s voice, you are responsible for obtaining any consents required in your jurisdiction.

Prohibited Conduct

You agree not to:

• Use the Service to harass, impersonate, defraud, or harm others.
• Upload content that is unlawful, infringing, deceptive, or obtained without required consent.
• Reverse engineer, decompile, or attempt to extract the source code or models of the Service, except as permitted by law.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or related systems.
• Use the Service to build a competing product or to train competing models.

Intellectual Property

The Service, including all software, models, designs, and content we provide, is owned by SpeakEQ or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.

Disclaimers

The Service provides communication and self-improvement tools. SpeakEQ is not a medical, psychological, therapeutic, diagnostic, or emergency service and should not be relied upon for medical or mental health decisions. Analysis results are informational and may be inaccurate or incomplete. The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, SpeakEQ and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim related to the Service is limited to the greater of the amount you paid us in the twelve months preceding the claim or fifty U.S. dollars.

Indemnification

You agree to indemnify and hold harmless SpeakEQ and its affiliates from any claims, damages, liabilities, and expenses arising out of your User Content, your use of the Service, or your violation of these Terms.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms or to protect the Service, our users, or third parties. Provisions that by their nature should survive termination will continue to apply after termination.

Governing Law

These Terms are governed by the laws of the jurisdiction in which SpeakEQ is established, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction, unless otherwise required by applicable law.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other reasonable means. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
